• The SPGA may make a Protection Order on any building within their area where owners will require the consent of the SPGA to demolish or alter that building under Sec. 5(1).
• To make a Protection Order the SCPA must give notice in writing to the owner(s) of the building stating that the building will be protected, what this will mean and provide a 28 day objection period from the owner(s) from the date of the notice under Sec. 5(2).
• If during the period of notice an offence occurs than the owner may be fined $840 on a summary conviction in Magistrates Court plus any fine payable to SGPA to restore the building to its former condition under Sec 5(3)(a).
• If no objection is lodged then SGPA can make a Protection Order under Sec. 5 (b).
• If the owner lodges an objection within the period then they can appear before the SGPA to state their case under Sec. 5(3)(c).
• The SPGA may revoke a Protection Order at any time but if they want to make a further Protection Order on the same building they must wait 6 months under Sec. 5(6).
